[EMILY MILLER WALKS ON THE STREET, STOPS TO LOOK AT FLOWERS FROM A FLOWER SHOP]

EMILY MILLER

Oh.

[GUNSHOT]

[EMILY IS SHOT DEAD]

MUSIC OUT

[WALLA]

LATER -

[DR. SHELDON HAWKES TAKES PHOTOS OF EMILY]

DR. SHELDON HAWKES

Shotgun blast.

MAC TAYLOR

Emily Miller. Last year at college. Organ donor.

DR. SHELDON HAWKES

Not much left in that department.

[HAWKES USES HIS TWEEZERS TO PICK UP A SMALL ITEM FROM EMILY’S CHEST]

DR. SHELDON HAWKES (CONTINUED)

This isn’t part of a flower. Hmm. Looks like a tooth.

MAC TAYLOR

Maybe a molar or a bicuspid.

DR. SHELDON HAWKES

Whatever it is, it’s not hers.

MAC TAYLOR

No sign of a bite mark near the wound. How did somebody else’s tooth get inside our victim’s body?

DETECTIVE DON FLACK

According to the florist and two witnesses, the vic was standing here picking out flowers when she went down. Blast came out a nowhere.

MAC TAYLOR

Pattern of the shot spread indicates it wasn’t close range. Ten feet would have made a wound with perhaps a fourinch diameter. Spread pattern here is broader, suggesting it came from at least 20 feet away.

DR. SHELDON HAWKES

Make that 20 feet above. If our eye witness accounts of her location are correct, the trajectory of the wound tract indicates she was shot, from a downward angle. Most likely--

[REENACTMENT]

DR. SHELDON HAWKES (V.O.) (CONTINUED)

You think a window or fire escape?

Window was nailed shut. Gun couldn’t have been shot from here.

[ZOOM INTO GARGOYLE]

[GUNSHOT]

MAC TAYLOR (CONTINUED)

The gun definitely hit this gargoyle. The question is, where’d it come from?

[ZOOM INTO CS OF GUN HIDDEN IN THE FOLD OF A CLOSED WINDOW AWNING]

[FLACK UNFURLS THE AWNING, REVEALING THE GUN]

CLOTHING STORE MANAGER

I closed up right after the shooting. Girl gets blown away right next door kind of puts things in perspective.

DR. SHELDON HAWKES

You were right. Gun must’ve bounced off the gargoyle and landed here.

MAC TAYLOR

After dislodging one of its rounds straight into an innocent victim.

DR. SHELDON HAWKES

Double barrel, one spent round.

MAC TAYLOR

Serial number’s been filed off. [MAC PROCESSES THE GUN] Positive for blood. Get this back to the lab, run the blood for DNA. Emily Miller was shot from two stories up, that blood couldn’t be hers.

DR. SHELDON HAWKES

Whose is it?

[ZOOM INTO UPPER FLOORS OF BUILDING]

EXT. BUILDING - ROOF - DAY

DR. SHELDON HAWKES

Killer could’ve tried to toss the gun off this roof into the garbage bins below.

MAC TAYLOR

And hit the gargoyle instead.

DETECTIVE DON FLACK

Guy’d be the last pick on my team. Bin’s a straight shot down.

DR. SHELDON HAWKES

Gravel here’s been disturbed. [FLACK’S CELL PHONE RINGS] Looks like our shooter went this way.

DETECTIVE DON FLACK

[INTO CELL PHONE] Flack.

MAC TAYLOR

Or came from that way.

DETECTIVE DON FLACK

[TO MAC AND HAWKES] We got a homicide. 884 92

MAC TAYLOR

That’s two buildings over. Let’s go.

[WALLA]

MUSIC OUT

MAC TAYLOR

What do we have?

DETECTIVE JESSICA ANGELL

William Riverton, 42, found murdered in his apartment, by his daughter.

MAC TAYLOR

Who are the boys?

DETECTIVE JESSICA ANGELL

Daughter’s boyfriend and his brother.

MAC TAYLOR

Don’t let ‘em leave before I talk to ‘em. nd.

DETECTIVE JESSICA ANGELL

How’d you get here so fast? Call just went out.

DETECTIVE DON FLACK

Busy neighborhood.

INT. RIVERTON’S APARTMENT - DAY

[SERIES OF PHOTOS OF RIVERTON’S BODY]

DR. SHELDON HAWKES

Skull cap is fragmented. Collapsed.

MAC TAYLOR

Could’ve been shot at close range, although I don’t see any stippling around the wounds.

DR. SHELDON HAWKES

There isn’t a gun around, so it wasn’t suicide.

MAC TAYLOR

Could also be blunt force trauma. It’s hard to say with all this blood.

[ZOOM INTO ECS OF RIVERTON’S MOUTH AND CHIPPED TOOTH]

DR. SHELDON HAWKES

His twelfth bicuspid is chipped.

MAC TAYLOR

We found a tooth fragment, in Emily Miller’s body.

[FLASHBACK]

[BACK TO SCENE]

DR. SHELDON HAWKES

I wonder if the two are related.

MAC TAYLOR

The neighbors hear anything?

STELLA BONASERA

TV was blaring when we came in. Only one other tenant on this floor, out a town. Now, there’s no sign of forced entry, no tool marks, lock and hinges are intact.

MAC TAYLOR

What about that window over there?

STELLA BONASERA

No access. Fire escape’s outside the bedroom, but that window’s locked from the inside.

MAC TAYLOR

So he either let his killer in or they had a key.

DR. SHELDON HAWKES

Blood on this napkin.

[STELLA LOOKS ON THE FLOOR TO A TINY ITEM SHE STEPPED ON]

MAC TAYLOR

The victim was most likely sitting here on the couch watching TV when he was hit.

[REENACTMENT]

[TV WALLA]

MAC TAYLOR (V.O.) (CONTINUED)

Could have heard something behind him.

[BACK TO SCENE]

MAC TAYLOR

This cast-off on the ceiling indicates the killer was standing here when he attacked.

[STELLA PICKS UP THE TINY ITEM FROM THE FLOOR]

DR. SHELDON HAWKES

There’s no blood leading away from the crime scene.

MAC TAYLOR

The couch was between the killer and the victim. If the killer had spatter on him, it would only be from the waist up.

STELLA BONASERA

Doesn’t look like a robbery. Found a $20,000 Patek Philippe watch and a wallet on the entry table. Along with the vic’s keys.

MAC TAYLOR

The severity of the attack indicates rage, someone who knew him.

STELLA BONASERA

And hated him. Vic’s a family court judge.

DR. SHELDON HAWKES

Now we’ll just have to find his jury.

STELLA BONASERA

And his executioner.

INT. APARTMENT BUILDING - LOBBY - NIGHT

DETECTIVE DON FLACK

You’ve been going out with Madison for how long?

JAKE FAIRWICK

Three months.

DETECTIVE DON FLACK

Did you ever meet Judge Riverton?

JAKE FAIRWICK

Once or twice, but I don’t think he approved of me. I’m not the Wall Street type.

CHARLIE FAIRWICK

I, I’ve never seen anything like that. Uh, not even in the movies.

INT. AMBULANCE - NIGHT

MAC TAYLOR

When was the last time you saw your father?

MADISON RIVERTON

Around one o’clock. He wanted to stay home, watch the game. I went out.

MAC TAYLOR

What’d you do?

MADISON RIVERTON

Took a walk. It was such a beautiful day. Afterwards, I went to the movie theater to meet up with Jake and Charlie. And we wanted to grab something to eat but, we didn’t have any money.

MAC TAYLOR

So you came home to get some from your father?

MADISON RIVERTON

[SOBS] That’s when I found him.

[REENACTMENT]

MADISON RIVERTON

Dad, I’m home. Must be watching TV.

[SCREAMS]

JAKE FAIRWICK

Oh, oh!

[BACK TO SCENE]

MADISON RIVERTON

Now I’ll never get that picture out of my head.

MAC TAYLOR

Ms. Riverton, I’m sorry for your loss. Are you sure the door was locked when you came home?

MADISON RIVERTON

[NODS YES] My dad would never leave the door unlocked. He didn’t like to take chances, you know, ‘cause of his work.

MAC TAYLOR

Has he gotten any threatening letters or phone calls?

MADISON RIVERTON

Over the years, yeah. Nothing recent.

MAC TAYLOR

Does anyone else have a key?

MADISON RIVERTON

Just the super, the maid and, of course, me.

MAC TAYLOR

Is there anyone you can stay with?

MADISON RIVERTON

I called my mom. She’s on her way here from Colorado.

DR. SID HAMMERBACK (V.O.)

C.O.D.--

INT. M.E.’S OFFICE - AUTOPSY ROOM - NIGHT

DR. SID HAMMERBACK (CONTINUED)

--was blunt force trauma. He was hit at least six times. Trauma presents in two distinct shapes. The ragged lacerations on the side of his head are parallel and horizontal. But the one on his mouth is more circular.

DR. SID HAMMERBACK (CONTINUED)

Dark bruising, clean edges suggest the one to the mouth was more of a jab. Which also, probably, chipped his bicuspid here.

[ZOOM INTO ECS OF TEETH THROUGH MAGNIFYING GLASS]

DR. SID HAMMERBACK (CONTINUED)

It’s a perfect match to the tooth fragment you found in, uh, Miss Miller there. How that happened, I can’t tell you.

MAC TAYLOR

We found a shotgun down the street from the judge’s building. I’m thinking the same weapon was used in both murders.

STELLA BONASERA

The butt of the shotgun could have caused the fracture wounds [MUSIC IN] to Riverton’s skull.

[FLASHBACK]

[BACK TO SCENE]

DR. SID HAMMERBACK

The smaller circular wound on his mouth is consistent with a gun barrel.

STELLA BONASERA

If it is the same weapon, when the judge was hit in the face, the tooth broke, slid into the barrel.

[REENACTMENT]

[BACK TO SCENE]

MAC TAYLOR

Could have been ejected with the buckshot when the gun hit the gargoyle.

DR. SID HAMMERBACK

And discharged itself into this poor woman. Who was probably only trying to brighten up her dinner table with a tasteful floral arrangement.

MAC TAYLOR

So the killer bludgeons Judge Riverton, escapes to the roof, tosses the gun over the side.

STELLA BONASERA

But why beat someone to death with a shotgun when you could just shoot them?

I’m worried about Danny. He was off yesterday but he was supposed to come in today.

STELLA BONASERA

I I.D.’d our hull. [MUSIC OUT] It’s part of a black sunflower seed. Get anything on the blood?

DR. SHELDON HAWKES

Nothing definitive, but Gentian violet revealed some ridge detail on the napkin.

STELLA BONASERA

Hmm. Could be a print. It’s hard to say. The weave of the fabric’s obscuring it.

DR. SHELDON HAWKES

Which means it’s still obscuring our killer.

INT. NEW YORK CRIME LAB - LAYOUT ROOM - DAY

LINDSAY MONROE

The blood you swabbed off the gun was a match to Judge Riverton. I was also able to match the shape of his head wounds with the butt and barrel of the gun.

MAC TAYLOR

Which still doesn’t explain why he was bludgeoned with it rather than shot.

LINDSAY MONROE

When I test-fired it with new rounds, it fired perfectly from the right barrel. But the left side malfunctioned.

[FLASHBACK/CSI SHOT]

[BACK TO SCENE]

LINDSAY MONROE (CONTINUED)

The firing pin is shorter than the manufacturer’s specs. In addition to that, the primer cup used on this brand of cartridge is made from a harder material than more modern primers.

MAC TAYLOR

Meaning it would take a lot more force than normal to detonate it, the kind of force that could have occurred when the gun smashed into the gargoyle.

[FLASHBACK]

[GUNSHOT]

LINDSAY MONROE (V.O.)

MAC TAYLOR

Maroon. That doesn’t get us very far. Danny’s shift started two hours ago. You heard from him?

LINDSAY MONROE

He got hit with the flu. He took some cold medicine, knocked him out. He just woke up.

MAC TAYLOR

Seems kinda sudden.

LINDSAY MONROE

He said he felt it coming on a few days ago.

STELLA BONASERA

We’ll be left with just the fingerprint.

DR. SHELDON HAWKES

At least that’s the theory.

STELLA BONASERA

Huh. Not a fingerprint. Could be a partial palm print.

DR. SHELDON HAWKES

That void there looks like a small scar.

STELLA BONASERA

Hmm. We got enough detail to run the print through AFIS. DNA on the sunflower seed.

DR. SHELDON HAWKES

You get a hit?

STELLA BONASERA

To an African gray parrot. DNA’s avian.

DR. SHELDON HAWKES

Sunflower seeds are used in bird feed.

STELLA BONASERA

The judge didn’t have any birds.

DR. SHELDON HAWKES

Killer could a tracked it in from somewhere else.

STELLA BONASERA

Let’s start with Riverton’s building. I’ll talk to the super, see if anyone has birds.

EXT. NEW YORK CITY STREET - DAY

EXT. APARTMENT BUILDING - DAY

JONAS STARK

The judge was president of the building’s co-op board. Uh, he ran it like this was his courtroom and we all were in contempt.

STELLA BONASERA

I understand Mr. Riverton filed a petition to have you evicted.

JONAS STARK

Twice, actually. He hated animals. Birds especially. “Rats with wings” he called them.

DETECTIVE JESSICA ANGELL

All these birds are legal imports, of course.

JONAS STARK

Yeah, of course.

STELLA BONASERA

According to the super, Mr. Riverton wanted you evicted because he thought your birds were unsanitary. Brought germs and disease into the building.

JONAS STARK

That man was paranoid. I mean, no one in the building liked him.

DETECTIVE JESSICA ANGELL

But you were the only tenant he was trying to evict. Maybe you went down to his apartment, tried to set him straight?

JONAS STARK

Absolutely not.

STELLA BONASERA

Mr. Stark, we found a sunflower seed at the crime scene. A black sunflower seed. Just like the ones over here.

JONAS STARK

Well, I sure as hell don’t know how they got there. I’ve never been in Riverton’s apartment. And neither have my birds.

DETECTIVE JESSICA ANGELL

Well, as much as we trust you, we’re still gonna need your prints.

STELLA BONASERA

MAC TAYLOR

You make any headway with the victim’s clothes?

DR. SHELDON HAWKES

The glittery powder on his shirt came back as gypsum drywall dust.

MAC TAYLOR

Well, we put that together with the paint Lindsay found on the gun, we might have something. According to the new rules regarding VOC emissions, oilbased exterior paint can only be sold to contractors.

STELLA BONASERA

Who would certainly have access to drywall.

MAC TAYLOR

Let’s find out if the judge’s recently divorce rulings involved anyone in the construction trade.

You askin’ or tellin’? ‘Cause I don’t like to be told what to do right now. Especially by some woman.

DETECTIVE JESSICA ANGELL

She said sit down.

STELLA BONASERA

Remolding the place?

LARRY ROSE

You could call it a work in progress.

STELLA BONASERA

Your divorce was finalized a week ago. The judge who presided over it was just found dead. What would you call that?

LARRY ROSE

A happy coincidence.

DETECTIVE JESSICA ANGELL

Is that supposed to be funny?

LARRY ROSE

Depends. You got a sense of humor?

DETECTIVE JESSICA ANGELL

Depends. You funny?

LARRY ROSE

[LAUGHS] Riverton gave everything I own to my wife. My ex-wife. Who I now have to repay for doing me the great favor a leaving me. Spent six years renovating this place. Six years. Now he says I gotta give it to her. So no problem. I’m gonna let her have it.

STELLA BONASERA

Uh, Mr. Rose, when was the last time you saw Judge Riverton?

LARRY ROSE

Yesterday. I knocked down a few walls, thought it’d make me feel better, but it didn’t. So I got his address off the Internet. Figured I’d knock him down too, maybe that’d work.

JUDGE WILLIAM RIVERTON

But you’re thinking about it or you wouldn’t be here. In the future, Mr. Rose, I recommend you do your thinking at home.

LARRY ROSE

What - home? You gave it to my wife, remember?

JUDGE WILLIAM RIVERTON

You put your hand on me again, I’ll issue a restraining order.

[BACK TO SCENE]

STELLA BONASERA

So you just left him there in the lobby of his building?

LARRY ROSE

Yep. Then bought a six-pack and went over to my ex-wife’s place in Jersey. The one that I am payin’ for her to live in.

DETECTIVE JESSICA ANGELL

And she’ll verify that?

LARRY ROSE

[GUFFAWS] Probably not. But the cops she called on me sure as hell will.

STELLA BONASERA

The Jersey P.D. confirms they picked up Mr. Rose on a domestic disturbance call at noon. He wasn’t let out of the precinct until four in the afternoon.

MAC TAYLOR

Which means he couldn’t have committed murder.

STELLA BONASERA

There must be something we’re not seeing. The only thing we haven’t accounted for is the paint Lindsay found on the shotgun.

MAC TAYLOR

And the question of access. Whoever did this knew their way around the apartment building and knew about the roof door.

STELLA BONASERA

And also got into [MUSIC IN] Riverton’s apartment without showing any sign of breaking and entering.

MAC TAYLOR

The super and the maid both had keys, but their alibis are rock solid.

MAC TAYLOR

This was a savage attack. The judge took six blows to the head, one hard enough to crack his skull. Is Madison Riverton physically capable of that kind of force?

STELLA BONASERA

Maybe she had some help.

MAC TAYLOR

Jake and Charlie Fairwick.

DANNY MESSER

Flack, I know. I know, I know. Flack, what-- Would you just think about what she’s goin’ through? I just need some time to find her. You never saw me, okay?

DETECTIVE DON FLACK

What’d the bondsman give you on Barnes?

DANNY MESSER

Old employers, a couple addresses, I got some hangouts. I don’t know how to find Rikki. But if I find Ollie Barnes, chances are, sooner or later, she’s gonna show up.

DETECTIVE DON FLACK

We split the list. Four hours. We come up empty after…

DANNY MESSER

Then we’ll call it in. Call it in. Absolutely. All right.

LINDSAY MONROE

The girl behind the counter remembers a whole conversation about the large combo.

MAC TAYLOR

Freeze it there. They’re wearing the exact same clothes all day.

LINDSAY MONROE

And judging by the lack of blood on those clothes, there’s no way they could have bludgeoned Judge Riverton to death.

MAC TAYLOR

Certainly doesn’t look like there’s a shotgun concealed anywhere on them.

DR. SHELDON HAWKES

Cameras picked ‘em up at three p.m. on their way out a the movie. Madison came to meet them. Madison called 911 fifteen minutes later at 3:15.

LINDSAY MONROE

Maybe Jake and Charlie weren’t involved. They were at the movies during our estimated time of death.

MAC TAYLOR

Question is, where was Madison?

MADISON RIVERTON (V.O.)

I told you.

INT. NYPD - INTERVIEW ROOM - DAY

MADISON RIVERTON

I was just wandering around. Don’t you ever do that?

STELLA BONASERA

Well, the problem is, Madison, no one saw you.

MADISON RIVERTON

I sat on a park bench and read. I did some window shopping. I didn’t exactly think I’d need an alibi. I can’t believe you think I had something to do with this.

STELLA BONASERA

I know your father was tough. He must have been difficult to live with.

MADISON RIVERTON

Sure. He was tough. But, it’s just because he had high expectations of me. What possible reason would I have for--. I can’t even say it.

STELLA BONASERA

For killing him? Well somebody had a reason and whoever it was had a key to your apartment.

MADISON RIVERTON

I swear, it wasn’t me.

STELLA BONASERA

He left you everything. You can move to Colorado now, live with your mother.

MADISON RIVERTON

How did you know about that?

STELLA BONASERA

Transcript from your parents’ divorce. You wanted to live with your mother. Your father wouldn’t let that happen. That would a made me pretty angry.

MADISON RIVERTON

You’re right. I hated him. I didn’t wanna be here. I wouldn’t even speak to him for a whole year. And now he’s dead. And I can’t tell him I’m sorry. I can’t tell him that I loved him and that I changed my mind.

STELLA BONASERA

Madison, I’m gonna have to ask for your palm prints.

INT. NEW YORK CRIME LAB - PRINT LAB - DAY

DR. SHELDON HAWKES

The ridge detail on Madison’s palm print doesn’t match the napkin.

MAC TAYLOR

And there’s no void. Where was this sunflower shell in relationship to the napkin?

DR. SHELDON HAWKES

Across the room, about 15 feet away.

MAC TAYLOR

If the shell blew down from the neighbor’s apartment into Riverton’s open window, how’d it end up all the way across the room? The window’s nowhere near the hallway.

DR. SHELDON HAWKES

Riverton could have tracked it in before he was killed.

MAC TAYLOR

Or maybe the killer tracked it. The ball of the foot and the heel of the palm are tough to distinguish.

DR. SHELDON HAWKES

You’re saying all this time we’ve been looking at a footprint?

MAC TAYLOR

What if the void on the napkin is from the shell?

DR. SHELDON HAWKES

It’s a perfect fit.

MAC TAYLOR

The killer could have tracked the shell across the floor with his bare feet.

DR. SHELDON HAWKES

But why commit murder without shoes on? It doesn’t make sense.

MAC TAYLOR

It does if they weren’t wearing any clothes.

DR. SHELDON HAWKES

That certainly would explain why Madison didn’t have any blood on her.

MAC TAYLOR

She killed her father and then took a shower.

INT. RIVERTON APARTMENT - BATHROOM - DAY

[HAWKES AND LINDSAY LOOK INTO THE SINK AND SHOWER DRAINS]

LINDSAY MONROE

Nothing. No blood. No hairs.

DR. SHELDON HAWKES

I’ll give her this. She’s smart.

LINDSAY MONROE

Bludgeoning your own father to death. That’s smart?

DR. SHELDON HAWKES

Smart in a cold-blooded kind of way. She washed away all the evidence.

LINDSAY MONROE

Maybe not all of it.

EXT. NEW YORK CITY STREET/INT. FLACK’S CAR - DAY

DETECTIVE DON FLACK

Danny, where the hell are you?

MUSIC IN

DETECTIVE DON FLACK

[INTO POLICE RADIO] Dispatch, I need a hit on a cell phone location. Number’s 212-555-0121.

INT. NEW YORK CRIME LAB - CORRIDOR - DAY

LINDSAY MONROE

The mystery compound I found on the shower curtain? It turned out to be soy bean oil, butter flavoring, beta keratin and citric acid. All of them, basic ingredients in popcorn topping.

MAC TAYLOR

Jake and Charlie Fairwick were at the movies.

LINDSAY MONROE

I did some checking. Theater they were at uses the exact same ingredients in its popcorn topping.

MAC TAYLOR

Riverton’s apartment is only three blocks away.

LINDSAY MONROE

You think they snuck out, killed Riverton, showered, then snuck back in?

MUSIC IN

MAC TAYLOR

Movie and a murder. Hell of a double feature.

EXT. MOVIE THEATER - ALLEY - NIGHT

LINDSAY MONROE

They could a come out this way without being noticed. Dark theater, nobody would’ve missed ‘em.

DR. SHELDON HAWKES

Yeah, must have wedged something in the door, so they could get back inside.

[LINDSAY LOOKS CLOSELY AT THE DOOR, FINDS A SCRAPE MARK]

[ZOOM INTO ECS OF SCRAPE MARK]

LINDSAY MONROE

Hawkes.

[LINDSAY SCRAPES OFF MAROON EXTERIOR PAINT]

INT. NEW YORK CRIME LAB - TRACE LAB - DAY

[LINDSAY PROCESSES THE PAINT CHIP]

LINDSAY MONROE

Cross-sectional analysis of the movie theater paint, is an exact match to the sample I got in the shotgun barrel.

[REENACTMENT]

LINDSAY MONROE (V.O.) (CONTINUED)

The boys must have hidden the gun on the ledge above the rear exit. And then nicked the door when they took it down.

[BACK TO SCENE]

LINDSAY MONROE (CONTINUED)

Which doesn’t tell us if they acted alone or if Madison put them up to it.

MAC TAYLOR

We just compared Madison’s footprint to one we found on the napkin. No match.

LINDSAY MONROE

If the boys did it, how did they get into the apartment?

MAC TAYLOR

Madison and Jake have been dating for two months. Somewhere in that time it’s possible that he got access to her key, made a copy.

LINDSAY MONROE

But why would the boys wanna kill Judge Riverton? They hardly knew him.

EXT. NEW YORK CITY STREET - DAY

[DANNY SITS ON HIS MOTORCYCLE. HE SEES OLLIE BARNES EXITING A BAR.]

MUSIC IN

[DANNY FOLLOWS OLLIE. FLACK DRIVES UP TO DANNY’S PARKED MOTORCYCLE, FOLLOWS OLLIE AND DANNY. RIKKI MOVES OUT OF A BUILDING’S ENTRANCEWAY, FOLLOWS OLLIE.]

EXT. ALLEY - DAY (CONTINUOUS)

[RIKKI PULLS OUT THE GUN, FOLLOWS OLLIE INTO THE ALLEY]

RIKKI SANDOVAL

He was ten.

OLLIE BARNES

Who?

DANNY MESSER

Rikki. Rikki!

RIKKI SANDOVAL

Go away, Danny.

DANNY MESSER

Rikki, put down the gun, please?

RIKKI SANDOVAL

He took everything from me.

OLLIE BARNES

I don’t even know you, lady.

DANNY MESSER

[TO OLLIE] Just shut up! Rikki, listen to me. Sweetheart, you don’t wanna do this.

RIKKI SANDOVAL

If he hadn’t robbed that store, Ruben would still be alive.

DANNY MESSER

I know you think that but if I would a stayed with Ruben, and made sure he got home, he’d be alive. That’s all I had to do, was stay with him. So if you wanna shoot someone…

[RIKKI LOWERS THE GUN]

RIKKI SANDOVAL

I want him back.

DANNY MESSER

I know. I know. Just, let me have the gun. Let me have the gun.

[DANNY HANDS THE GUN TO FLACK]

OLLIE BARNES

Crazy bitch ought to be locked up.

DANNY MESSER

Why don’t you get the hell outta here?

OLLIE BARNES

If you ask me, that kid caught a lucky break. Might have ended up a nut job like his old lady.

[DANNY HITS OLLIE]

DETECTIVE DON FLACK

Danny! Danny! Dan! [TO OLLIE] Get outta here. Get the hell outta here!

OLLIE BARNES

Yeah.

DETECTIVE DON FLACK

Danny? Are you taking her in or am I?

DANNY MESSER

She’s not going in!

DETECTIVE DON FLACK

You know this has got to be put on paper. That mug’s probably already on the phone with his lawyer telling him all about this.

DANNY MESSER

Flack, I’m gonna take her home.

DETECTIVE DON FLACK

I’ll be at my desk. I’ll give you one hour. After that I’ll do what I gotta do.

INT. NEW YORK CRIME LAB - MAC’S OFFICE - DAY

STELLA BONASERA

Turns out the Fairwick boys were originally the Highford boys. Mother died when they were young. Father worked three jobs, raised them until the ACS entered the picture. Court ruled he was unfit.

MAC TAYLOR

Says here they were with four different foster families. Must a been tough. Let me guess. Judge Riverton is the one who took ‘em away from their father.

STELLA BONASERA

He called it a case of parental neglect.

MAC TAYLOR

Think we just found our motive.

STELLA BONASERA (V.O.)

It was brilliant, Charlie.

INT. NYPD - INTERROGATION ROOM - DAY

STELLA BONASERA (CONTINUED)

Whose idea was it to take your clothes off?

MUSIC OUT

CHARLIE FAIRWICK

I don’t know what you’re talkin’ about. We didn’t do anything.

[MAC SHOWS HIM PHOTOS OF DEAD JUDGE RIVERTON]

MAC TAYLOR

That’s hard to look at, isn’t it?

STELLA BONASERA

We found oil from popcorn topping--

[FLASHBACK]

STELLA BONASERA (V.O.) (CONTINUED)

[BACK TO SCENE]

MAC TAYLOR

That’s what got you, Charlie. It’s always that one little mistake.

STELLA BONASERA

And that show you put on at the movie theater.

[FLASHBACK]

STELLA BONASERA (V.O.) (CONTINUED)

Ordering the jumbo combo so the girl--

MAC TAYLOR

Did you know when you threw that gun off the roof you killed another person? [MUSIC IN] An innocent girl?

[FLASHBACK]

[BACK TO SCENE]

STELLA BONASERA

Her name’s Emily Miller. She was shopping for flowers.

MAC TAYLOR

Look at her. She’s only 22 years old! Wanna tell us why you did this, Charlie?

CHARLIE FAIRWICK

Our father loved us. Had to work three jobs just to support us. So he left me and my brother home a lot.

STELLA BONASERA

You were seven and Jake was nine. You were too young to be left alone.

CHARLIE FAIRWICK

Look, Riverton called it neglect. There was no neglect. All my father ever did was love us. He did everything that he could for me and my brother.

MAC TAYLOR

Jake’s eighteen now. Legally he could a gone to live with your father, but he didn’t.

CHARLIE FAIRWICK

My father died three months ago in the South Bronx.

DETECTIVE JESSICA ANGELL

We found him hiding in the basement of his building.

MAC TAYLOR

Take a seat, Jake.

CHARLIE FAIRWICK

Jake, don’t say anything.

JAKE FAIRWICK

It’s too late, Charlie. Not lettin’ you go down for something I did.

CHARLIE FAIRWICK

Jake.

JAKE FAIRWICK

Shut up. My brother had nothin’ to do with this. I was the one who planned it. I hooked up with Madison. Made a copy of her key. Then I found out when the judge would be home alone. Went there to kill the son of a bitch. Charlie just stood there. It was me. All me.

[FLASHBACK]

JAKE FAIRWICK

Charlie, go take a shower. Charlie!

[BACK TO SCENE]

MAC TAYLOR

One crime, five victims. Emily Miller and Judge Riverton lost their lives. Madison lost a father. And you two lost your future.

DETECTIVE DON FLACK

Yeah, something came up with Danny. It-- It’s a, long story. How ‘bout I tell you later over an Irish coffee?

DETECTIVE JESSICA ANGELL

I think I know just the place.

[DANNY AND RIKKI WALK INTO THE BULLPEN]

DETECTIVE DON FLACK

Jess, would you take her inside?

DETECTIVE JESSICA ANGELL

Sure.

MUSIC IN

DETECTIVE DON FLACK

Messer, hang on a sec.

DANNY MESSER

What, Don? What do you want me to say?

DETECTIVE DON FLACK

I called ahead to arraignment. She’ll be walked through the system, released on her own recognizance. She won’t spend a night in jail.

DANNY MESSER

You know what? You should a minded your own business.

DETECTIVE DON FLACK

You’re my friend, Danny… makes it my business. You’ve gotta stop blaming yourself for Ruben’s death.

[FLASHBACK]

DANNY MESSER

Ruben, go straight home, Ruben. Go straight home.
